Citation: At approximately 0755 on 9/14/11, I approached the 3rd inspection stand because I had been informed a bird had been hung back on the PHV shackle. The bird was not on the PHV hook or any other hook at that station. The inspector informed me that he had hung back a cadaver bird for final disposition by the veterinarian. He later informed me that he had hung the bird approximately 30 minutes prior, and that when he glanced over 2 minutes prior to my arrival, the bird was still there. He informed me it was red down the sides and other areas. When I spoke with (QA Manager) and then (First Processing Manager), they were unable to locate the bird. They searched salvage and the hang back racks. At approximately 0815 hours I informed that if he could not produce the bird, he would have to dump salvage, particularly the parts. I observed as over two yellow barrels worth of parts and carcasses were condemned. Tape, which was missing from the PHV shackle, was placed on the hook to identify it. informed me verbally that he would inform his employees of the proper procedure in regards to birds hung back for veterinary disposition. The identity of carcasses held back for further examination must be maintained until final examination has been completed. In addition, all birds showing signs of having died from causes other than slaughter shall be condemned. The establishment must ensure that birds hung back on the PHV hook are not removed by the plant employees and that adulterated product does not re-enter the flow of production. The establishment has received both oral and written notification of this noncompliance. Failure to meet regulatory requirements could result in additional enforcement action as described in 9 CFR part 500.


381.77 Each carcass, including all parts thereof, in which there is any lesion of disease, or other condition which might render such carcass or any part thereof adulterated and with respect to which a final decision cannot be made on first examination by the inspector, shall be held for further examination. The identity of each such carcass, including all parts thereof, shall be maintained until a final examination has been completed.
