Citation: On Friday, 06-17-2011, at approximately 0753 hours, while performing an unscheduled review and observation component for the 01C02 procedure in the Main Cooler, I observed chicken fat particles various sizes on the inside surface of the top stacked brown tote. At close examination, I observed chicken fat particles and black specks various sizes on the product contact surfaces of ten (10) (four (4) blue and six (6) brown totes) out of twenty-five (25) totes I inspected from previous day's operation. I rejected approximately one hundred and fifty (150) blue and brown totes with US Rejected Tag B39 133545 for unsanitary condition. (Quality Assurance) was present during my observation. I informed (Quality Assurance Manager) of my observation. After reviewing the plant's SSOP records and GMP Monitor's records there were no entries documented prior to my observation of the noncompliance. I reviewed the plant's SSOP Pre-Operational Inspection Form #4 for Packing Department's which shows no deficiencies for the above noncompliance. The area was released for inspection at 0643 hours for inspection. Establishment management has received oral and written communication concerning these noncompliance's. Continued failure to comply with regulatory requirements could result in additional enforcement action as described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: Establishment response to previous preventive measure is as follow; "Sanitation will clean the totes and they will be inspected by QA Technician or designee. Once totes have been found acceptable they will be placed in the cooler for the next days production. If totes are found to be unacceptable they will be re-washed prior to the next days pre-operational inspection or tagged and placed on QA hold to be re-cleaned'. Previous preventive measures were either ineffective or not implemented to prevent this recurrence of this noncompliance; NR: 38-2011 dated 5/23/2011


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
