Violation: 416.13(c), 416.4(a)

Citation: At approximately 0530 hours, after plant's pre-operational sanitation and prior to the start of operation, while performing (01B02) pre-op sanitation procedure the following noncompliance was observed in the Evisceration department. I observed fat residue on the contact surface of the inside area of the opening machine spoons. I rejected the opening machine with U.S Rejected/Retained tag no.B38670154. I informed of my observation. At approximately 0542 hours I reinspected the opening machine and found it acceptable, I then relinquished regulatory control action. After reviewing the plant's pre-operational inspection form # 2 for (Evisceration) showed deficiencies for the opening machine (1-residue, 4-grease and 5-product residue). The area was release for USDA inspection and signed by designated person at 0512 hours. There was no product involved with these noncompliances. This is a failure to comply with 9 CFR 416.4(a) and 9CFR 416.13(c). Past Similar NRs - Previous Ineffective Plant Actions: Employees responsible for pre-op will be retrained for performing pre-op. Employees will be retrained on July 17 by or . On June 17 a meeting was held with the ownership and management of contract sanitation company; Ronell Management Services. NR: 33-2010 dated 6/16/2010 The previous preventive measures were either not implemented or were ineffective in preventing the recurrence of this noncompliance. Continued failure to comply with regulatory requirement could result in additional enforcement action described in 9CFR part 500.4.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
