Citation: On Monday, June 18, 2012, at approximately 0630 hours, after the establishment had completed their pre-operational inspection and prior to start of the operation, I observed the following non-compliance. A perforated stainless steel bowl (12" x 12" x 4") with about 50 to 100 Buddhist style wing tags inside was left on top of a cardboard box in a corner of the live poultry holding area near exit to the backyard, uncovered. Upon further inspecting the condition of these wing tags and the stainless steel bowl, I noticed that a few pieces of feathers and dry-out muscles from previous production were on the surface of the stainless steel bowl and also on some of the wing tags. (Wing tag is affixed to the wing of each poultry carcass sold to retail store to meet the labeling requirement.) An U.S. Rejected Tag (#B38033325) was applied to this stainless steel bowl and the wing tags until corrective action could be performed. Evidence was immediately shown to the plant manager, nbsp; No products were affected.This observation is a non-compliance with Regulation 9 CFR 416.13 (a) and 416.4 (a). Continued failure to meet the regulatory requirements would lead to further enforcement action.


416.13(a) Each official establishment shall conduct the pre-operational procedures in the Sanitation SOP’s before the start of operations.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
