Citation: At approximately 0615 hrs after performing pre-operational sanitation inspection, SPHV and CIS found the following noncompliance: In the establishment's freezer, finished packaged product was stored on both sides of the freezer. The freezer fan closest to the doorframe was visibly spitting out large amounts of water onto the packaged product stored underneath the fan. There was a moderate amount of frozen condensation throughout the ceiling as well as heavy amounts of dripping condensation throughout the underside of the freezer fan. Most of the products packaged in paper bags (shipping containers) were seen also further packaged in protective clear plastic bags. But approximately 10 bags stored in the freezer were seen not further packaged in clear plastic bags and were wet. plant president, was immediately informed of this noncompliance. The bags were retained with U.S. Retain Tag No B37802952. After plant employees removed the bags from the freezer, SPHV found three very wet bags with a 3-5 inch tear in each one and exposing silkie carcasses. One other bag with product was found completely soaked to the inner lining. In this bag, there was no inner clear plastic bag around the carcasses and product was found exposed to the soaked inner lining. Another bag not wrapped in outer plastic was opened to show that there was no inner plastic lining and then this bag was dropped on the floor by exposing product to the floor. Mr. walked away from this product to address the picking machine, which broke down. This product was retained with U.S. Retain Tag #B37802948. As part of his corrective action, opted to condemn all birds in these 5 bags and approximately 100lbs of birds were denatured in front of USDA personnel. For the approximately 5 remaining bags, one bag was had only the outer lining of the bag very wet and the inner lining dry. Plant management repackaged this product. The regulatory control action was removed after verifying the remaining bags were in acceptable condition and demonstrated to me that the product was first packaged in clear plastic bags before going into these paper bags, preventing direct product contamination. The establishment's SSOP states under operational inspection, "[redacted]" Past similar NR #0026-2011-17846 dated 06/16/2011. The further planned action "We clean the freezer the packaged product to look good" was ineffective. The freezer condensation was discussed in a weekly meeting dated 6/17/2011.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
