Citation: At approximately 1100 hrs I observed four of the establishment's brown paper bags in the back cooler. These bags were closed and labeled with the establishment's name, address, and official establishment number (4734-P). On the outside of the bags "[redacted]" was handwritten. Upon further investigation, the bags contained noneviscerated ducks individually identified with wing tags from establishment [redacted]. When asked, the establishment [redacted] indicated that these bags had been delivered this morning from establishment , and that this establishment had sent their pre-labeled bags to [redacted] for packaging of product to be purchased by this establishment. Establishments cannot use another plant's establishment number on product that they processed. 9CFR Reg 381.11(b) indicates that although this product is religious exempt from certain regulations, it is subject to all of the other applicable provisions of the Act and the regulations, including 9CFR 381.115. This is a non-compliance with 9CFR Reg 381.11(b). Inspected and passed poultry products are required to be labeled. Shipping containers for religious exempt poultry must bear the following features: 1. establishment's name and address or city, state, and zip code when listed in a public directory, and 2. the appropriate exemption statement: "Noneviscerated Poultry Processed under USDA Exemption Permit No.__" The product was retained with US Retained Tag No. B39795421. Plant owner, Mr. was immediately notified of this non-compliance.


381.115 Except as may be authorized in specific cases by the Administrator with respect to shipment of poultry products between official establishments, each shipping container and each immediate container of any inspected and passed poultry product shall at the time it leaves the official establishment bear a label which contains information, and has been approved, in accordance with this subpart.
