Citation: At approximately 1130 hrs in the cooler between the evisceration room and break room, I observed thirteen chicken carcasses in a holding tank that did not have wing tags or another form of identification. The thirteen carcasses were retained by USDA reject/retain tag #39907680. This condition does not fulfill the requirements of 9CFR 381.115 which states that inspected and passed poultry products are required to be labeled. Although this establishment has a religious exemption, they are still subject to all of the other applicable provisions of the Poultry Products Inspection Act and the regulations 9CFR 381.115. For religious exempt poultry, items for retail sale must be individually identified with tags providing the following features: 1. A statement that the product was processed under a Buddhist or Confucian or a statement of equal meaning. 2. The name of the religious official or organization under whose supervision the pouty was slaughtered. 3. The official establishment name and address. 4. The establishment number. This noncompliance is linked to NR # 0030-2010-17846 dated 8/2/10 for failing to meet 9CFR 381.115.


381.115(a)(1) Authorization to establish specifications. The Administrator is authorized to establish specifications or definitions and standards of identity or composition, covering the principal constituents of any poultry product with respect to which a specified name of the product or other labeling terminology may be used, whenever he determines such action is necessary to prevent sale of the product under false or misleading labeling. Further, the Administrator is authorized to prescribe definitions and standards of identity or composition for poultry products whenever he determines such action is otherwise necessary for the protection of the public. The requirements of this subpart are hereby found to be necessary for these purposes and standards are hereby established as set forth in this subpart.
