Citation: At approximately 1215 while performing a un-scheduled 06D01 task code, I found the following non-compliances. In the evisceration department, I found five flies flying about the room. I immediately applied US REJECT tag B38-785544 to the evisaration room, and operation was suspended. The plant manager, Mr [redacted] was verbally informed of the non-compliance. The regulatory requirements of 416.2(b)(3, 416.1 as well as 416.4(d) ,the Meat and Poultry regulations were not met. The U.S.D.A inspector explained to the plant manager in charge of the operations , that doors not closing tightly allowed the entrance of vermin such as flies, rats, and mice.This could cause product adulteration or the creation of insanitary conditions if allowed to come into contact with product, and could pose a public health issue if product enters commerce. The plant manager, Mr. [redacted]. immediately took corrective action by removing all product in operation to the cooler. The exposed tables, walls, and floors, were sanitized. After I verified the corrective actions, the reject tags were removed and production resumed as normal. The plant manager gave instructions to the crew working in the evisceration department to be more observant when observing flies or other insects in the department . This document serves as a written notification that your failure to comply with the regulatory requirements could result in additional administrative actions.


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
